Australian Visa Changes from 1 July 2017: Permanent Employer Sponsored Visas

Included in the Australian Government’s 1 July 2017 Australian visa reform package, are amendments to the employer sponsored visa program, including the Employer Nomination Scheme (subclass 186) and Regional Sponsored Migration Scheme (subclass 187).

A summary of the changes to the subclass 186 and 187 visa are outlined below:

Eligible Occupation Lists for Permanent Employer Sponsored Visas

For subclass 186 visas – from 1 July 2017 the Combined Eligible Occupation List will apply to the  Direct Entry Stream, which include those occupations listed in the Short-term Skilled Occupations List (STSOL) and the Medium and Long-term Strategic Skills List (MLTSSL). Relevant caveats specified in these occupation lists will also apply to the subclass 186 visa Direct Entry stream.

Eligible subclass 186 Temporary Residence Transition (stream occupations will be those that were approved for the Temporary Work (Skilled) (subclass 457) visa.

The Federal Government has stated that the occupation list changes for 1 July 2017 will not impact the subclass 187 visa which does not utilise the eligible skilled occupation lists.

Caveats for Permanent Employer Sponsored Visas

Caveats which were introduced on 19 April 2017 applying to the Temporary Work (Skilled)(subclass 457) visa program, will also apply to Direct Entry subclass 186 visa applications from 1 July 2017.

Caveats have placed specific requirements on several nominated occupations in terms of minimum salary, business turnover, number of workers employed by the sponsoring business, employment experience of the visa applicant, nature of the business or required location in a regional area.

English Language Requirement

From 1 July 2017, the English language requirement for subclass 186 and 187 visas has now changed for the Transitional visa stream from ‘vocational’ to ‘competent’ English, which requires:

  • A score of 6.0 in each of the four test components of the IELTS test;
  • a score of at least ‘B’ in each of the four test components of an Occupational English Test (OET);
  • A minimum test scores in each of the four test components: 12 for listening, 13 for reading, 21 for writing and 18 for speaking, in a Test of English as a Foreign Language internet-based test (TOEFL iBT) test;
  • A test score of at least 50 in each of the four test components (speaking, reading, listening and writing) in a Pearson Test of English (PTE) Academic test; or
  • A test score of at least 169 in each of the four test components (speaking, reading, listening and writing) in a Cambridge English: Advanced (CAE) test that has been undertaken on or after 1 January 2015 and prior to lodging the visa application.

The English language requirement of ‘competent’ English for the Direct Entry Stream of subclasses 186 and 187 visas remains the same at 1 July 2017.

Age requirement

From 1 July 2017, the maximum age requirement of below 45 at the time of application will apply to Direct Entry stream applicants for the subclass 186 and 187 visas.

The maximum age requirement of below 50 at the time of application will continue to apply to Temporary Residence Transition stream applicants.

Changes to Australian Work Visas

Major changes have been and are in the process of being introduced to Australian work visas and the Employer Sponsored visa program.

Following the announcement by the Federal Government on 18 April 2017 that significant changes would take place to the Australian work visa program, the amendments came into effect yesterday. Changes to both the temporary work visa stream and permanent Employer Sponsored visas will be introduced in stages as follows:

Temporary Employer Sponsored Visas

19 April 2017 Changes

Temporary Work (Skilled)(subclass 457) visas

Current holders of subclass 457 visas will be able to continue to hold their visa until the expiry date. Pending subclass 457 visa applications will be subject to the new occupation lists and applicants no longer eligible for this visa will need to withdraw their applications.

Subclass 457 applications lodged from 19 April 2017 onwards must have an occupation on the new occupation lists.

New Occupation Lists

The Consolidated Sponsored Occupation List (CSOL) has been replaced by the new Medium and Long Term Strategic Skills List (MLTSSL) and Short Term Skilled Occupation List (STSOL).

As it stands, 216 occupations have been removed from the CSOL, including the more common nominated occupations of Human Resource Adviser, Procurement Manager, Public Relations Manager, Importer or Exporter, Retail Buyer and Web Developer. See enclosed complete removed occupations list.

Occupation Caveats

Caveats have been introduced to 59 occupations on the STSOL. The Department of Immigration and Border Protection (DIBP) has announced that visa applications where the nominated occupation falls within the scope of the ‘caveat’ will not be approved.

Duration of Visa Grant

Short-Term stream:  For visa applicants granted a subclass 457 visa from 19 April 2017 with an occupation on the STSOL, the visa can only be granted for 2 years with only one further extension allowed for another two years. Australian permanent residency through the subclass 186/187 Employer Sponsored scheme will not be allowed.

Medium-Term stream:  For visa applicants granted a subclass 457 visa with an occupation on the MLTSSL, it can be granted for 4 years. Visa holders will be able to apply for a permanent 186/187 visa after 3 years on a 457 visa if the employer agrees to nominate the visa holder.

1 July 2017 Changes

From 1 July 2017, the following changes announced by the Federal Government that will be introduced to the subclass 457 visa program include:

English salary exemption $96,400 is to be removed.

Training benchmarks for subclass 457 business sponsors are to set to be changed.

Mandatory penal clearance certificates will be required for all subclass 457 visa applicants.

8 March 2018 Changes

Introduction of Temporary Skill Shortage (TSS) visa

The new Temporary Skill Shortage (TSS) visa will replace the subclass 457 visa from March 2018.

Visa applicants for the TSS will require an occupation on the STOSL or MLTSSL and two years’ relevant work experience.

Permanent Employer Sponsored Visas

19 April 2017

Occupation Lists

Eligible occupations for the Employer Nomination Scheme (subclass 186) visa and Regional Sponsored Migration Scheme (subclass 187) visa on the CSOL have been condensed with 216 occupations removed and 24 occupations restricted to regional Australia.

The CSOL has been replaced with a combined STSOL and MLTSSL for eligible occupations.

1 July 2017

Occupation Lists:  The STSOL will be further reviewed based on advice from the Department of Employment. The MLTSSL will be revised based on outcomes from the Department of Education and Training’s 2017-18 Skilled Occupation List review.

English Language Requirement:  A requirement of an International English Language Testing System (IELTS) (or equivalent test) score of 6 in each component will be introduced.

Age:  For the Direct Entry Stream, a maximum age requirement of 45 at the time of application will be introduced.

For the Temporary Residence Transition stream, a maximum age requirement of 50 at the time of application will continue to apply.

March 2018

Occupation Lists:  For the subclass 186 and 187 visas: Only the MLTSSL will apply, with additional occupations available to support regional employers for the RSMS.

Minimum Salary Rate: A minimum market salary rate will be introduced whereby employers must pay the Australian market salary rate as well as meeting the Temporary Skilled Migration Income Threshold.

Age Requirements:  All visa applicants must be under the maximum age requirement of 45 at the time of application.

Australian visa dependents

Redefining Dependents for Australian Visa Applications

Redefining dependents for Australian visa applications- The Department of Immigration and Border Protection (DIBP) has recently narrowed the definition of “members of the family unit” of a visa applicant who can be included in the visa application to travel to Australia. These changes took effect at the end of 2016.

Essentially, dependent relatives other than children are no longer able to be included and children of visa applicants are now required to be “dependent” on the primary visa applicant, either because they are under 18, are under 23 and do not support themselves or over 23 and incapacitated to work. The new definition does not apply to certain visas such as humanitarian and student visas which each have their own requirements.

Previous definition of dependency

Prior to 19 November 2016, it was possible to include dependent relatives on various Australian visa applications who were ‘members of the family unit’ of the primary visa application.  This was quite a broad definition as in addition to partners and children, parents and other relatives could be included provided the visa applicant could show financial and practical dependency.

New definition of dependency

The DIBP has narrowed the definition of dependency and now the only “members of the family unit” that can be included in relevant Australian visa applications are as follows:

  • Partners (including spouses and de facto partners);
  • Children (including biological, step and adopted children) under 18 and certain other eligible children of the primary visa applicant (as explained below); and
  • Any dependent child of eligible children of the primary visa applicant.

It is important to note that children of the primary visa applicant over the age of 23 can generally no longer be included as they were in the past.  Children between the ages of 18 and 23 can only be included if they are financially dependent on the primary applicant.  There is a limited exception where a dependent child over the age of 23 is incapacitated to work.

Grandfathering Arrangements

Grandfathering arrangements have been implemented by the DIBP for people already holding temporary visas who may apply for permanent residency at a future date.  Therefore, secondary applicants who have been granted visas by the DIBP as “members of the family unit” will be deemed to continue to meet this definition when applying for permanent Australian visas.

Holders of the following visas are deemed to be “members of the family unit” even if they no longer meet the new definition when applying for Australian permanent residency:

  1. Members of the family unit of Temporary Work (Skilled)(subclass 457) visas applying for Employer Nomination Scheme (ENS)(subclass 186) and Regional Sponsored Migration Scheme (RSMS)(subclass 187) visas;
  2. Members of the family unit holding Skilled Regional Provisional (subclass 489) visa applying for Skilled Regional Permanent (subclass 187) visas; and
  3. Members of the family unit of Temporary Contributory Parent visas applying for permanent Contributory Parent (subclass 243 and 864) visas; and
  4. Members of the family unit of Provisional Business Skills (subclass 188) visas applying for Permanent Business Skills (subclass 888) visas.

The grandfathering arrangements also apply to holders of a subclass 457 visa who apply for a further subclass 457 visa.

Regional Sponsored Migration Scheme (RSMS) Skilled Occupation List

From 1 July 2015, if you are applying for a Regional Sponsored Migration Scheme (RSMS) (subclass 187) visa, you must nominate an occupation from the Skilled Occupation List published by the Department of Immigration and Border Protection (DIBP).

Perth to be Reclassified as a “Regional City” of Australia for Immigration Purposes

In an attempt to address the skilled labour shortage in Perth, the Federal Government has announced that Perth will be considered a “regional city” of Australia.

The reclassification will path the way for Perth to be included in the regional sponsored migration scheme which will enable Perth businesses to sponsor foreign workers under the comparatively more relaxed criteria for permanent and temporary migration.
